1. Acceptance of Terms

By accessing or using ThePicks (accessible at thepicks.io), operated by Guideway Consulting, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Service Description

ThePicks is a creator-curated shopping platform that connects brands and creators. Our services include:

For Customers: Browse and purchase products curated by creators through personalized shelves.
For Creators: Build curated product shelves, share recommendations, and earn commissions on sales.
For Brands: List products, connect with creators, and access subscription-based brand tools.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your account credentials.
You must be at least 14 years of age to create an account.
One person may not maintain more than one account without prior approval.
You agree to notify us immediately of any unauthorized use of your account.

4. Orders & Payments

All prices are displayed in USD unless otherwise specified.
Payments are processed securely through Stripe and PortOne. By making a purchase, you agree to each processor’s terms of service.
An order is confirmed when payment is successfully processed. You will receive an email confirmation with your order details.
We reserve the right to refuse or cancel orders in cases of suspected fraud, pricing errors, or product unavailability.
Prices may include applicable taxes and shipping fees, which are displayed at checkout.

5. Shipping & Delivery

Shipping timelines are estimates and may vary depending on the destination and carrier.
Risk of loss passes to you upon delivery to the carrier.
You are responsible for providing an accurate shipping address. We are not liable for delays or losses caused by incorrect address information.

6. Refunds & Cancellations

Product order refunds and cancellations are governed by our Returns & Exchanges Policy — all sales are final, and refunds or replacements are provided for eligible claims (damage, defect, incorrect, missing, or undelivered items). Brand subscription refunds are governed by our Refund & Cancellation Policy.

7. Creator Terms

Creators must apply and be approved before creating a shelf on the platform.
Creators earn commissions on qualifying sales made through their curated shelves.
Commission rates and payout schedules are determined by ThePicks and may be updated with prior notice.
Creators must not engage in misleading promotion, fake reviews, or any deceptive practices.
We reserve the right to suspend or terminate creator accounts that violate these terms.

Campaign participation

Applying to a campaign is a commitment to create and post content on TikTok if the brand selects you. Applications are not exploratory.
If you are selected, you agree to publish the content by the deadline shown in that campaign's details, and to follow the brand's Content Guide and posting requirements.
Unless the campaign states otherwise, posted content must disclose the paid or gifted partnership in line with local advertising rules, mention that the product is available on ThePicks, and tag both ThePicks and the brand.
After posting, you agree to send ThePicks the original content file and to grant ThePicks and the brand the right to reuse that content in marketing for [12 months] from the posting date.
Products sent for a campaign are provided for the purpose of creating that content. If you accept a product and do not deliver the agreed content, ThePicks may withhold campaign rewards, invoice the value of the product, or exclude you from future campaigns.
Withdrawing after selection is allowed if you notify ThePicks before the product ships. After shipping, the commitment stands.

8. Brand Terms

Brands must apply and be approved to list products on the platform.
Brands are responsible for the accuracy of product information, pricing, and availability.
Brand subscriptions are billed on a recurring monthly basis. Subscription terms are detailed in the Refund & Cancellation Policy.
Settlement payouts are processed according to the agreed settlement method and schedule.

9. Prohibited Conduct

You agree not to:

Use the platform for any unlawful purpose or in violation of any applicable laws
Impersonate any person or entity, or misrepresent your affiliation
Interfere with or disrupt the platform or its infrastructure
Attempt to gain unauthorized access to other accounts or systems
Engage in fraudulent transactions, chargebacks, or abuse of the refund system
Scrape, crawl, or use automated means to access the platform without permission
Upload or transmit malicious code, spam, or harmful content

10. Intellectual Property

All content on ThePicks, including design, logos, text, and software, is owned by Guideway Consulting or its licensors.
Creators retain ownership of their original content but grant us a license to display and promote it on the platform.
You may not reproduce, modify, or distribute any platform content without written permission.

11. Limitation of Liability

ThePicks is provided "as is" without warranties of any kind, express or implied.
We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
We do not guarantee the accuracy of product information provided by brands or creators.

12. Termination

You may close your account at any time by contacting us at support@thepicks.io.
We may suspend or terminate your account if you violate these terms or engage in prohibited conduct.
Upon termination, any pending orders will be fulfilled, and outstanding commissions or settlements will be processed according to their respective schedules.

13. Dispute Resolution

Any disputes arising from these terms or your use of the platform shall be governed by the laws of the Republic of Korea. Both parties agree to attempt to resolve disputes amicably before pursuing legal action. The competent court shall be the Daejeon District Court, Republic of Korea.

14. Changes to Terms

We may modify these Terms of Service at any time. Material changes will be communicated via email or a notice on the platform at least 7 days before they take effect. Continued use of the platform after changes constitute acceptance.

Creator Information: Social media account details (TikTok, Instagram, YouTube), UGC reference URLs, country of residence, and affiliate experience survey responses.

Order & Payment Information: Shipping address, order details, and payment information processed through Stripe. We do not store full credit card numbers; only the card brand and last four digits are retained for reference.
Communications: Any messages or inquiries you send to us via email or other channels.

2.2 Information Collected Automatically

Usage Data: Pages viewed, click logs, referring URLs, access times, and interaction patterns with the platform.
Device Information: Browser type, operating system, device type, and IP address.
Cookies: We use cookies and similar technologies to maintain your session and improve your experience.

5. Data Retention

Account information is retained for as long as your account is active.
Order and payment records are retained for 5 years from the transaction date, as required by applicable tax and commercial laws.
Upon account deletion, personal information is removed within 30 days, except where retention is required by law.
Usage and analytics data may be retained in anonymized form for service improvement.

6. Data Security

We implement industry-standard security measures, including encrypted data transmission (HTTPS/TLS), secure password hashing, and access controls. Payment processing is handled entirely by Stripe, a PCI DSS-compliant payment processor. While we strive to protect your information, no method of transmission over the internet is 100% secure.

7. Your Rights

Depending on your jurisdiction, you may have the right to:
